Terms of Service

1. Acceptance of Terms
By accessing or using the Aviamatic LLC software, platform, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you are accepting these terms on behalf of an organization (such as an aviation maintenance organization), you represent that you have the authority to bind that organization to these terms.
2. Description of Service
Aviamatic provides a B2B software platform designed to manage tool custody, calibration tracking, and location workflows for aviation maintenance. The Service records execution evidence, but Aviamatic does not make airworthiness decisions, issue release-to-service authorizations, or guarantee regulatory compliance. Our customers are solely responsible for their own maintenance, competence, and airworthiness determinations according to their approved manuals (e.g., MOE).
3. Customer Responsibilities
- Compliance: Customers must ensure their use of the Service complies with their own internal quality systems, EASA/FAA regulations, and local laws.
- Authorized Users: Customers are responsible for managing the access credentials and permissions of their personnel.
- Data Accuracy: The integrity of the system relies on the accuracy of the data inputted (e.g., tool scans, calibration dates). Customers are responsible for the validity of the data they enter into the Service.
4. Data Privacy and Security
Our processing of personal data on your behalf is governed by our Privacy Policy and a mutually agreed upon Data Processing Agreement (DPA). We employ industry-standard security measures, but no system can guarantee absolute security. You are responsible for configuring your accounts securely.
5. Intellectual Property
Aviamatic retains all right, title, and interest in and to the Service, including all software, design, text, and graphics. Customers retain all rights to the data they input into the Service. We grant customers a limited, non-exclusive, non-transferable license to use the Service during the subscription term.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVIAMATIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
8. Modifications to Terms
We may modify these terms at any time. We will notify customers of material changes via email or through the Service. Continued use of the Service after any such changes constitutes your acceptance of the new Terms of Service.
